We’ve tried to keep our Terms and Conditions as clear as possible, and give you all the information we can about your online transactions so that you completely understand the whole process, from order to delivery and beyond. It’s really important to us that your experience using our site is enjoyable and safe, so please spend a few minutes and read on. By using and accessing our website, caffeottavo.co.uk (collectively referred to as the “Site” or “Caffè Ottavo” in these Terms of Service), you (“you”, “user” or, “end user”) agree to these Terms of Service (collectively, the “Terms of Service” or “Agreement”).
You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, transfer, create derivate work from, sell or re-sell any content or information obtained from or through the Site.
The Site may contain links to other websites maintained by third-parties. These links are provided solely as a convenience and does not imply endorsement of, or association with, the party by Caffè Ottavo.
Modifications to this Agreement.
Caffè Ottavo reserves the right to change or modify any of the terms and conditions contained in this Agreement at any time. You acknowledge and agree that it is your responsibility to review the Site and these Terms of Service from time to time. Your continued use of the Site after such modifications to this Agreement will constitute acknowledgment of the modified Terms of Service and agreement to abide and be bound by the modified Terms of Service.
Termination of Use.
Caffè Ottavo shall have the right to immediately terminate or suspend, in its discretion, your access to all or part of the Site with or without notice for any reason.
Limitation of Liability.
In no event shall Caffè Ottavo or its affiliates be liable for any indirect, incidental, special, punitive damages or consequential damages of any kind, or any damages whatsoever arising out of or related to your use of the Site, the content and other information obtained therein.
Certain jurisdictions prohibit the exclusion or limitation of liability for consequential or incidental damages, thus the above limitations may not apply to you.
Any disputes arising out of or related to these Terms of Service and/or any use by you of the Site shall be governed by the laws of the United Kingdom, without regard to the conflicts of laws provisions therein.

TERMS OF SALE
We reserve the right to reject any orders at our discretion without liability to you, for example: if products listed on our site become unavailable or contain pricing or description errors; if we do not receive payment authorisation; if shipping restrictions apply.
Caffè Ottavo shall under no circumstances be held liable for any losses to specific circumstances of the customer, indirect or consequential losses or for loss of profits, damage or property, or wasted expenditure.
We take every care to ensure that descriptions and specifications of its products are correct within the website. Whilst ensuring that colour reproduction of images is close to reality, we do not guarantee perfect accuracy and do not accept responsibility for colour variation caused by computers and/or browsers. We reserve the right to change product specifications, prices, packaging and any related service at any time, without prior notice.
You may cancel your order anytime before the order has reached our distribution warehouse. We would then refund you the amount paid for the product, except any handling and logistics costs. After that time, cancellations made through refusal of delivery will be liable to delivery and return costs.
Please contact us if you wish to change the delivery address, phone numbers or other pertinent information. Such changes are subject to approval by us and may incur additional costs.
A contract between you and Caffè Ottavo for the sale of our products will only exist once we confirm your order by e-mailing you to confirm your order has been accepted. The contract will be deemed to have been formed and the confirmation deemed to have been given to you as soon as you are able to access the message, whether or not you actually received that message. The contract shall be deemed to have been concluded in the United Kingdom and shall be governed by the laws of England and you irrevocably submit to the non-exclusive jurisdiction of the English Courts.
We deliver anywhere in UK, Scotland and Ireland, and selected European destinations, as outlined on our Shipping page. Delivery prices will vary depending on delivery location, and may include surcharges for remote or hard to reach locations. All quoted delivery prices are subject to change. Please contact us for details of the possibility of shipping outside the UK.
We aim to dispatch any orders received on a working day within 24 hours, for delivery within the UK within 72 hours. However, please allow 7-14 days for delivery. In extreme circumstances, if a product is not available, you must agree to a accept a full refund for the price of your item and shipping, provided that nothing was shipped to you in that order.
Please contact us if you wish to change the delivery address, phone numbers or other pertinent information. Such changes are subject to approval by Caffè Ottavo and may incur additional costs.
We do not accept liability for delays in delivery caused by third-party courier/delivery companies.
Following the Distance Selling Regulations, you are entitled to a refund as long as you return your goods within 7 working days (working days means all days other than Saturday, Sunday and public holidays from the day after delivery). The goods must be in an ‘as new’ condition and returned in the original, undamaged packaging, along with all accessories received with it. The product must be in perfect condition and unused. You are responsible for the condition of your goods until they reach us, so pack your items carefully to prevent damage in transit. Worn, damaged or incomplete returns will not be eligible for a refund.
For Espressina Coffee & Tea Pod Machines: In the unlikely event that your product develops a fault, we try to make our returns or repair service as painless as possible. If the fault with your product occurs within its guarantee period (12 months from delivery) we will offer you a prompt repair service, or an exchange, at our sole discretion. In all cases we reserve the right to inspect the product and verify the fault. If goods become defective within three months of delivery, we will pay for collection of the faulty items and delivery of the replacement. After this time, we will not pay to collect faulty items. We do not cover faults caused by accident, neglect, misuse or normal wear and tear. Items sold on this website are intended for consumer use and not for resale. This returns policy does not affect your statutory rights.
